President Bush Signs Landmark Housing Bill Into Law

Housing Bill Promotes Energy Efficient Mortgages

A provision to improve and promote energy efficient mortgages is included in the Housing aid legislation that the Senate passed on Saturday.  The bipartisan proposal was put forward by Sens. Jeff Bingaman and Pete Domenici, chair and ranking member of the Senate Energy Committee.

Energy efficient mortgages could play an important role in a national effort to make homes more energy efficient.  Residential housing accounts for about 22 percent of all energy use, and a similar percentage of greenhouse gas emissions.  Many Federal agencies and some banks already offer such mortgages, and Fannie Mae and Freddie Mac are authorized to purchase them.  So, rather than creating a new mortgage product, the provision directs Federal agencies to identify barriers that have prevented widespread adoptions of such mortgages; gives recommendations to Congress to alleviate obstacles if found, and authorizes a public education and marketing campaign for the mortgages.

Sen. Bingaman: “With high energy prices expected to continue, a streamlined energy efficient mortgage process would make energy efficient new homes and energy retrofits much more attractive to builders and consumers.  Promoting energy efficient homes will reduce the amount of energy we consume in our homes while also helping mitigate the effects of global warming.”

Sen. Domenici:  “American homes serve as the front-line for improved energy efficiency.  I’m pleased that the bill managers have accepted our amendment to identify obstacles that are making it more difficult to build, buy or renovate energy efficient homes.  In this time of rising energy costs, we should do everything possible to help people use less energy—and spend less money.”

Gary Ehlert, Peter Merrill, Mike Chapman, Jack Milarch and the home builders’ delegation from New Mexico met with representatives: Heather Wilson, Steve Pearce, and Tom Udall from the House of Representatives and Senators: Pete Domenici and Jeff Bingaman during Legislature Day, April 30, 2008 in Washington DC.  The delegation pressed for alleviating the housing mortgage crunch and a housing stimulus package.

“Culminating months of intensive advocacy efforts by the entire NAHB federation, President Bush on July 30 signed into law a major housing stimulus package. “This landmark bill contains several provisions to help home buyers, stop the slide in home prices, provide a lifeline to borrowers facing foreclosure, improve mortgage liquidity and bolster confidence in mortgage giants Fannie Mae and Freddie Mac,” said NAHB President Sandy Dunn. “We commend Congress and the President for taking this action to provide much-needed relief to the American people.”

H.R. 3221, the Housing and Economic Recovery Act of 2008, includes several provisions aimed at ending the current cyclical downturn in the housing industry and strengthening the housing finance system so that it will provide critical support as the marketplace gains strength. The centerpiece of the housing bill is a temporary, $7,500 first-time home buyer tax credit for the purchase of any home. The tax credit can be used for homes purchased between April 9, 2008 and July 1, 2009. It is expected to provide a significant—and temporary—financial incentive for home buyers.

The key elements of the Housing Bill are:

A temporary $7,500 first-time home buyer tax credit. The tax credit will stimulate home buying, reduce excess supply in housing markets and shore up home prices. For details on how the tax credit works, NAHB has set up a new Web site at http://www.federalhousingtaxcredit.com/

FHA modernization. A revitalized FHA will have greater flexibility to respond to the needs of borrowers, enable more working families to become home owners and play an important role in the mortgage markets. The new law includes a permanent increase in the loan limit for FHA-insured mortgages to 115 percent of an area’s median home price—up to $625,500. It also enables the FHA to simplify requirements for condominium loans. However, the FHA will now require a 3.5 percent downpayment from buyers rather than the previous 3 percent and seller-assisted downpayment programs must end as of Oct. 1.

FHA modernization. Foreclosure relief.  To address the foreclosure crisis, the FHA is given additional authority to insure up to $300 billion of mortgages to refinance loans headed for foreclosure. The Congressional Budget Office estimates this could help as many as 400,000 struggling borrowers to stay in their homes.

GSE (government-sponsored enterprise) reform. The law reforms the regulation of Fannie Mae and Freddie Mac and permanently increases the conforming loan limit to help buyers in high-cost markets.

Backstop for Fannie Mae and Freddie Mac. To reassure financial and global markets, the government will temporarily expand its line of credit to Fannie and Freddie and permit the U.S. Treasury to purchase an equity stake in the companies through the end of 2009.

Mortgage Revenue Bond Program. The measure gives states the ability to issue an additional $11 billion in mortgage revenue bonds, which will help strapped borrowers seeking to refinance their home loans.

Low Income Housing Tax Credit. Enhancing this program will expand the supply of much-needed affordable rental housing.-

Update on Legal action on the City of Santa Fe Inclusionary Zoning

Affordable housing is critical to the quality of life and economic health of Santa Fe.  The members of the Santa Fe Area Homebuilders Association are committed to continuing to produce quality affordable homes for Santa Fe families as we have been for decades.

It is time, however, to recognize that homebuilders and developers cannot shoulder the burden on their own and that the entire community must participate in providing solutions that are sustainable and equitable.... we have asked the court to allow us to join the recently filed federal lawsuit. 

At this time we are awaiting the Court’s decision as to whether they will grant the Association “standing” in the lawsuit.

Mike Chapman, Chapman Homes, and Peter Merrill, Construction Dispute Resolution Services along with Gary Ehlert, Executive Officer of SFAHBA, presented information on the intervention to the Legal Action Committee of the National Association [NAHB]. 

The National Association has submitted the following:

“The Committee recommends that if the [SFA] HBA is successful in intervening in the litigation, NAHB would support the subsquent litigation ...subject to current NAHB policy”

New Mexico Home Builders Association’s [NMHBA] Executive Committee approved “in concept the lawsuit and the efforts of SFAHBA to obtain standing.”

Haciendas - A Parade of Homes Builders and Committee

The Haciendas committee has worked diligently to present Haciendas - A Parade of Homes for 2008.  Forty Homes will showcase the unique Santa Fe Style by the area’s finest craftsmen. Homes will be open for two weekends in August: Friday, Saturday and Sunday, August 15-17 & 21-24.  The homes will be open to the public from 11:00am - 6:00pm.  On Thursday August 21 some homes will remain open from 11:00am - 9:00pm.  Tickets ( $15) and the Resource Guide : Haciendas-A Parade of Homes are available at sponsor locations throughout Santa Fe and also at each of the Parade homes. Come & Enjoy!

Judging will take place August 12-14, 2008.  Awards will be given in each price category for:

• Best Exterior Character
• Best Craftsmanship
• Best Planning/Circulation/Livability
• Most Creative and Innovative and, of course, the Grand Hacienda.

SFAHBA Partners with Santa Fe Habitat for Humanity

WOMEN BUILD

The Women of SFAHBA have formed over 10 teams of Volunteers for the Habitat for Humanity Women’s Build. image The women of SFAHBA will be building a home in Oshara for Maria, her parents and her adopted son. The motto of the Women’s Build is “Built by Women for Women”.  Construction began Saturday, May 10th at the ground breaking ceremony and will continue through October..  If you would like to form a team- 6 or more women, NO Building Skill Required- or join a team please contact Cheri.

BUILDER BLITZ

SFAHBA assisted by Chapman Homes is teaming up with Habitat for a ‘Builder Blitz’. SFAHBA members will build a Habitat for Humanity Home in Oshara Village in ONLY one week September 13-20 2008. The Chapmans succesfully lead a Builder Blitz in 2006 and we are pleased to announce they will be on hand to advise and assist SFAHBA president, Kim Shanahan with the endeavor this year.  We are looking for donations of labor and materials.  The committee has been meeting every two weeks in the SFAHBA Conference room. If you would like to be part of the Builder Blitz 2008 please contact Kim Shanahan.

SFAHBA/HABITAT GREEN BUILD

In October Habitat for Humanity and the Association will build a home on the corner Paseo de Peralta and Gomez Street.  This home will use Green building techniques and will showcase Green Technologies. It will be highlighted by the Green Building Summit and Expo in November. The project goes before the Historic Review Board the evening of August 26. Donations of labor and materials are most welcome!  If you would like to be a part of this exciting project please contact Kim Shanahan.

The Santa Fe Area Home Builders Association will hold a Green Building Summit and Expo in the new Convention Center, November, 2008.  The Summit will feature Ed Mazria as the keynote speaker and will bring in National speakers to educate builders, architects, realtors, appraisers, inspecters, bankers, and financial analysts on the Value of Green Building. Attendee’s will earn CEU’s in their respective fields. A position paper will be drafted and summitted to the media as well as the New Mexico Legistature, Governor Richardson’s office and the New Mexico Representatives and Senators. Tours will be given to the Green Built Habitat Home as well as exceptional Green-built homes in the Santa Fe Area.

At the noon lunch break on Friday, November 21, the Summit attendees will preview the Green Building Expo. The second annual trade show, the Green Building Expo, will feature products and services in Green Building.  The City will have a booth to answer questions on the new City of Santa Fe green building code as well as Santa Fe’s future as a leader in ecological, sustainable, environmentally-sensitive building. The Expo will open to the public later Friday afternoon and will continue on Saturday, November 22 from 10am-5 pm and Sunday, November 23, 10am - 3pm.

Zero and Near Zero Energy Homes Are Here!

The Santa Fe Area Home Builders Association is leading the way to net zero and near zero energy homes. Faren Dancer, Chair of the Green Building Council broke ground on The Emerald Home.  The inspiration for this ZERO ENERGY HOME came in 2006 when he saw an Al Gore-type presentation by Ed Mazria, a pioneer in Santa Fe’s passive solar construction. It showed seas rising from global warming, swallowing America’s coastlines.

“I decided I was only going to build zero-energy homes from that time on,” said Dancer. The group is considering how to meet the 2030 Challenge—a goal adopted by the Santa Fe Area Home Builders Association, the City of Santa Fe, the American Institute of Architects and the U.S. Congress of Mayors to have zero carbon emissions from new buildings by the year 2030.

Faren, SunDancer Creations, is taking the lead and showing the Santa Fe Builders and, in fact, the rest of the nation how to build a zero energy home.  The ‘Emerald Home” is a 4,125-square-foot home in Monte Sereno, a development south of the Santa Fe Opera.

Faren believes that we have to work together to create the future we know we need to create.

Bob Kreger, Kreger Design Builder, will present a near-zero energy home in the 2008 Haciendas-A Parade of Homes this August. [2008] --the first LEED for homes platinum certification in New Mexico.

“We’re proving that homes can be built to very high green standards without sacrificing any of their beauty and comfort,” says architect Bob Kreger, AIA, who designed and built the updated Pueblo-style home for clients who are passionate about energy conservation. Located on 2.5 acres northwest of Santa Fe, it captures expansive views of the Sangre de Cristo Mountains. The home is 2,300 square feet with four bedrooms and two baths. With interior finishes designed by Nancy Kreger, it features all the luxury expected in a fine custom home—tile floors, beamed ceilings, spacious bathrooms, and artistic trims. But there is much more. This is a near-zero-energy residence!  It uses 80% less energy than a typical, “built-to-code” home today.

This anticipated Platinum Certified home will be open to the public Sunday August 10, 2008, and again Sunday August 29, 2008, from 1:00 to 5:00 to promote public awareness of LEED for Homes. This home will also be open during the Santa Fe Area Homebuilders Parade of Homes, August 15-17 and 21-24.
